These Terms of Use ("Terms") govern your use of https://www.apexarmamentllc.com (the "Site"). They also govern your purchases, training classes, and services from Apex Armament LLC ("Apex Armament," "we," "us"). By using the Site, booking a class, or buying from us, you agree to these Terms, our Store Policy, and our Privacy Policy. If you do not agree, do not use the Site or our services.

We are a veteran- and law-enforcement-owned, appointment-only firearms dealer. We hold Federal Firearms License 6-04-023-07-8L-16565 (Type 07, Class 2 SOT) and Massachusetts Dealer License D2004284D.

2. Age Requirements

You must be 18 or older to use the Site to make purchases or bookings.

  • Handgun purchases and handgun ammunition require you to be 21 or older.
  • The Give Back Sweepstakes is open only to people 21 or older.
  • Training classes have their own age rules, set out in our Store Policy.

By using the Site, you confirm that you meet the age requirements for what you buy or book.

3. Legal Requirements for Firearm Sales & Transfers; Buyer Responsibility; Right to Refuse

  • Compliance with law. All firearm sales and transfers follow all applicable federal, state, and local laws, including the Gun Control Act, the National Firearms Act, ATF regulations, Massachusetts General Laws chapter 140, and the Massachusetts Attorney General's firearms regulations. Full details are in the "Legal Requirements for Firearm Sales & Transfers" section of our Store Policy.
  • Eligibility and age. You must be legally eligible and of legal age: 21 or older for handguns and LTC-required firearms, and 18 or older for rifles and shotguns where the law allows purchase with an FID. You must show valid government-issued photo ID and, for Massachusetts residents, a current Massachusetts LTC or FID (or other license the law requires). Ammunition purchases also require a proper Massachusetts license.
  • Massachusetts compliance. Massachusetts handgun roster and Attorney General compliance rules apply.
  • Transfers. Every firearm transfer requires completing ATF Form 4473 in person, a federal (FBI NICS) background check and any Massachusetts check the law requires, and all required Massachusetts reporting. Firearms are never shipped to consumers.
  • Non-residents. Handguns are sold only to Massachusetts residents. Rifles and shotguns go to non-residents only where the transfer is lawful in both states.
  • Our right to refuse. We may refuse, cancel, or delay any sale, transfer, booking, or service, at our sole discretion and to the extent the law allows. This includes any case where we believe a transaction may be unlawful, may be a straw purchase, or may put anyone at risk. Buying a firearm for someone else who is not the actual buyer is a federal felony.
  • Suppressors and NFA items are sold only to law enforcement agencies and qualified government contractors, under Apex Armament policy.
  • Your responsibility. You are solely responsible for knowing and following all federal, state, and local laws on buying, owning, possessing, carrying, transporting, storing (including the Massachusetts safe-storage law), and using firearms, ammunition, parts, and accessories, wherever you live or travel. This information is not legal advice (see Section 5).

4. Training, Range Activities, and Demonstrations: Assumption of Risk and Release

Firearms training, live fire, range activities, and product demonstrations ("Activities") carry inherent risks. These risks include serious bodily injury, permanent disability, hearing or vision damage, lead exposure, and death. They can be caused by your own actions, the actions of others, equipment or ammunition malfunctions, or range conditions.

By booking or taking part in any Activity, you agree that:

  1. Voluntary participation. You take part voluntarily and knowingly assume all risks of the Activity, both known and unknown.
  2. Safety rules. You will follow all safety rules, range commands, and instructor directions at all times. You will not take part while under the influence of alcohol, cannabis, or any drug or medication that may impair you.
  3. Fitness to participate. You are physically and mentally able to take part, and you will tell the instructor about any condition that may affect your safety.
  4. Release. To the fullest extent permitted by Massachusetts law, you release, waive, and agree not to sue Apex Armament LLC and its owners, instructors, employees, and agents for any claims arising from your participation, including claims caused by ordinary negligence.
  5. Written release. You will sign our separate Training Acknowledgment, Assumption of Risk, and Release before taking part. That signed document controls if it conflicts with this Section.
  6. What this release does not cover. It does not cover gross negligence, willful or reckless misconduct, or any liability that cannot legally be waived.

Training is educational. Completing a class does not make you an expert. It does not certify you to carry or use a firearm in any particular situation, and it does not guarantee that any license will be issued.

5. No Legal Advice

Information on the Site and anything our staff tells you about firearm laws, licensing, transport, storage, self-defense, or use of force is general information only. It is not legal advice. Laws change and vary by location. Consult a licensed attorney about your situation.

6. Product Information, Accuracy, and Pricing Errors

  • We try to keep product descriptions, availability, class schedules, and prices accurate, but errors can happen.
  • We may correct errors, update information, and cancel any order or booking listed at an incorrect price or with incorrect information, even after you have received a confirmation. If we cancel, we will give you a full refund of any amount paid.
  • Photos are for illustration and may not show the exact item.
  • Inventory is limited, and items may sell out.
  • Prices and availability may change without notice.

7. Give Back Sweepstakes

The Apex Armament Give Back Sweepstakes is governed by its Official Rules, posted at https://www.apexarmamentllc.com/giveaway-rules. If these Terms and the Official Rules conflict about the Sweepstakes, the Official Rules control.

No purchase is necessary to enter or win. Void where prohibited.

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available."

  • To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not promise that the Site will be uninterrupted, error-free, or free of viruses.
  • Products are covered only by their manufacturer's warranty, if any. We give no other warranty unless a written warranty says so.
  • Nothing in this Section limits any warranty or right that cannot be excluded under Massachusetts consumer protection law.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Apex Armament and its owners, employees, instructors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site, our products, or our services.
  • Our total liability for any claim is limited to the amount you paid us for the product or service that the claim is about.
  • Some laws do not allow these limits, so they apply only as far as the law permits.

10. Indemnification

You agree to defend, indemnify, and hold harmless Apex Armament and its owners, employees, instructors, and agents from any claims, losses, damages, and expenses, including reasonable attorneys' fees, that arise from:

  1. Your breach of these Terms or our Store Policy;
  2. Your violation of any law;
  3. Your misuse of any firearm, ammunition, product, or service; or
  4. Any false information you give us, including on ATF Form 4473 or a license application.

11. Intellectual Property

The Site's content belongs to Apex Armament or its licensors and is protected by copyright and trademark law. This includes the Apex Armament name and logo, text, photos, graphics, and merchandise designs.

  • You may view the Site for personal, non-commercial use.
  • You may not copy, reproduce, sell, or use our content or trademarks without our written permission.
  • Third-party brand names and trademarks belong to their owners.

12. Acceptable Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose;
  • Submit false information or use someone else's identity or payment card;
  • Interfere with the Site's security or operation;
  • Use bots or scripts to place orders or sweepstakes entries; or
  • Harass our staff or customers.

13. Third-Party Services and Links

Payments are processed by our third-party payment processor on its secure hosted payment page. Bookings may be handled by a third-party scheduling service. Your use of those services is also governed by their terms. We are not responsible for third-party websites or services linked from the Site.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute arising from these Terms, the Site, or our products or services must be brought exclusively in the state or federal courts located in Plymouth County, Massachusetts, and you consent to their jurisdiction. Before filing any claim, you agree to contact us first and try in good faith to resolve the dispute informally.

15. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new effective date. Your continued use of the Site or our services after an update means you accept the revised Terms. The Terms in effect when you made a purchase or booking apply to that transaction.

16. General

  • Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
  • No waiver: our failure to enforce a provision is not a waiver of it.
  • Entire agreement: these Terms, our Store Policy, our Privacy Policy, and any signed release or Official Rules that apply make up the entire agreement between you and us about their subject.
