Apex Armament LLC ("Apex Armament," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through our website at https://www.apexarmamentllc.com (the "Site"), when you book a class, buy from us, enter our Give Back Sweepstakes, or visit our shop. It also explains how we use, share, and protect that information.

Apex Armament is a veteran- and law-enforcement-owned, appointment-only firearms business located at 992 Bedford Street, Unit M-3, Bridgewater, MA 02324. We hold a Federal Firearms License (Type 07, with Class 2 SOT status) and a Massachusetts dealer license (D2004284D).

1. Information We Collect

Information you give us.

  • Contact details: name, email address, phone number, and mailing address.
  • Orders and bookings: what you buy or book (for example, training classes or Give Back merchandise packages), size choices, pickup appointments, and messages you send us.
  • Payment information: you enter card details on our payment processor's secure payment page. We see limited details, such as your name, the card type, and the last four digits. We do not receive or store full card numbers or security codes.
  • Training records: class attendance, completion status, certificates issued, and any signed release or waiver.
  • Sweepstakes entries: your name, contact details, date of birth, state of residence, and, if you are a winner, eligibility and tax documents (for example, an affidavit of eligibility and IRS Form W-9).
  • Firearm transaction information: when you buy or transfer a firearm or regulated item in person, federal and state law require us to collect and keep certain information. This includes your government-issued photo ID, date and place of birth, address, ATF Form 4473 answers, Massachusetts license (LTC/FID) details, and background check results.

Information collected automatically. When you visit the Site, our website host (Squarespace) and similar tools may collect your IP address, browser and device type, the pages you view, referring websites, and the date and time of your visit. This happens through cookies and similar technologies. See Section 6.

Information from others. We may receive information from our payment processor (for example, whether a payment went through), our scheduling provider, government background check systems (FBI NICS and the Massachusetts firearms licensing and transaction systems), and receiving dealers (FFLs) involved in a transfer.

2. How We Use Your Information

We use personal information to:

  • Process payments, fulfill orders, schedule pickups, and give refunds;
  • Schedule, run, and keep records of training classes, and issue certificates;
  • Run the Give Back Sweepstakes: record entries, conduct drawings, contact and verify winners, award and transfer prizes, and meet tax reporting duties, as described in the Official Rules;
  • Complete firearm sales and transfers and meet our legal duties as a federal and Massachusetts licensed dealer;
  • Answer your questions and provide customer service;
  • Send you marketing emails, such as our monthly build ideas and Give Back news, only if you opt in (for example, by checking the optional box at checkout, which is never pre-checked). Opting in is never required to buy from us or to enter the Give Back Sweepstakes, and opting in or out has no effect on your entries or odds. Every marketing email includes an unsubscribe link and our physical mailing address, and we honor unsubscribe requests within 10 business days, as the federal CAN-SPAM Act requires. You can unsubscribe at any time;
  • Prevent fraud, chargeback abuse, and illegal or straw purchases, and protect our customers, staff, and business; and
  • Comply with the law, respond to lawful requests, and enforce our policies.

3. How We Share Your Information

We do not sell your personal information, and we do not share it with others for their own marketing. We share information only as follows:

  • Service providers who help us run our business under confidentiality obligations. These include our website host (Squarespace), our scheduling/booking provider (Vagaro), our payment processor and gateway (Fortis / coreCLEAR, with our sponsor bank, Fifth Third Bank, N.A.), and email providers.
  • Government agencies, as required by law. These include the ATF, the FBI (NICS), the Massachusetts Department of Criminal Justice Information Services (DCJIS/MIRCS), local licensing authorities, the IRS (for prize reporting), and law enforcement responding to a valid legal process such as a subpoena, warrant, or ATF trace request.
  • Other licensed dealers (FFLs) when you ask us to ship a firearm or prize to a dealer for transfer.
  • Legal and safety reasons: to protect our rights, property, or safety, or that of our customers or others, and to investigate fraud.
  • Business transfers: if our business is sold or reorganized, subject to the law, including federal rules on firearm records.

Text messages: we do not share mobile phone numbers or text-message opt-in consent with third parties or affiliates for their marketing purposes.

4. Firearm Transaction Records

Federal law requires licensed dealers to keep certain records, including ATF Form 4473 and our acquisition and disposition records, and to make them available to the ATF. Massachusetts law also requires dealers to report and keep records of transactions. These records cannot be deleted or changed at a customer's request. We keep them as long as the law requires and protect them as described below.

5. How We Protect Your Information

  • Card payments are processed by a PCI DSS compliant payment processor on a secure, encrypted (HTTPS/TLS) payment page. Card data goes directly to the processor and never through our website.
  • The Site is served over HTTPS.
  • We limit access to personal information to people who need it, and we keep paper records, including Form 4473s and mail-in sweepstakes cards, in a secured area.
  • We use reasonable administrative, technical, and physical safeguards to protect personal information, consistent with Massachusetts law.
  • If a security breach involving your personal information occurs, we will notify you and the authorities as required by law (M.G.L. c. 93H).

No method of transmission or storage is 100% secure, but we work to protect your information using reasonable safeguards.

6. Cookies and Analytics

Our Site uses cookies needed for it to work, and may use analytics cookies to understand how visitors use it. You can block or delete cookies in your browser settings. Some Site features may not work without them. Our Site does not currently respond to "Do Not Track" browser signals. 7. How Long We Keep Information

We keep personal information only as long as needed for the purposes described above. Specifically:

  • Firearm transaction records: as long as federal and state law require.
  • Order, payment, and refund records: 7 years, for tax and accounting.
  • Training and waiver records: 7 years.
  • Sweepstakes entry records, drawing records, and mail-in cards: at least 3 years after the drawing, consistent with the Official Rules.
  • Marketing lists: until you unsubscribe.

8. Your Choices and Rights

  • Marketing: click "unsubscribe" in any email, reply STOP to any text, or contact us.
  • Access and correction: contact us to request a copy of, or a correction to, the personal information we hold about you.
  • Deletion: you may ask us to delete your information. We will do so unless we must keep it by law (for example, firearm transaction, tax, or sweepstakes records) or for a legitimate business purpose such as fraud prevention or a pending chargeback.

Depending on where you live, you may have additional privacy rights under your state's law. To make a request, contact us in person or by email using the information below. We respond within 1 to 2 business days. We may need to verify your identity before responding.

9. Age Limits

Our Site, products, and Sweepstakes are intended for adults. Training classes may have their own age rules (see our Store Policy). We do not knowingly collect personal information online from children under 13. If you believe a child has given us information, contact us and we will delete it.

10. Third-Party Sites

Our Site may link to third-party websites and services, such as our payment page, scheduling page, and social media. Those sites have their own privacy policies, and we are not responsible for their practices.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date. If the changes are material, we will provide more prominent notice.
